Prior to becoming a member of our site MyWeddingIsOver you must read and accept all of the terms and conditions of this user agreement and Privacy Policy. By accepting this agreement you also agree that any use of other sites or links associated with MyWeddingIsOver.com may be governed by separate user agreements and privacy policies. All agreements and policies that apply to MyWeddingIsOver.com will be located at the footer of our domains and subdomains.

While using MyWeddingIsOver, you will not:

*distribute or post spam, chain letters, or pyramid schemes this also includes asking members to share or sell their current listings onto other sites not affiliated with MyWeddingIsOver;

* fail to deliver items purchased from you, unless the buyer fails to meet the posted terms, or you cannot authenticate the buyer's identity;

* post false, inaccurate, misleading, content (including personal information) nor post any defamatory or derogatory statements to or about users;

* manipulate the price of an item or interfere with other site user's listings;

* manipulate our fee structure, the billing process, or fees owed to MyWeddingIsOver;

* collect information about users, including email addresses, without their consent.

*copy, modify, or distribute content from the Sites and MyWeddingIsOver's copyrights and trademarks;

*distribute viruses or any other technologies that may harm MyWeddingIsOver, or the interests or property of MyWeddingIsOver users;

*transfer your MyWeddingIsOver account (including feedback) and User ID to another party without our written consent;

* take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off of the sites or using it for purposes unrelated to MyWeddingIsOver);

* fail to deliver payment for items purchased by you, unless the seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity;

* use our sites or services if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our sites;

* violate any laws, or third party rights;

* post inappropriate content or items;

Abusing MyWeddingIsOver

We would like all the users within the site to do their best to help bring all issues and violations to our attention. MyWeddingIsOver and the users can work together to keep the site and services in the community working properly and safe.

If issues should arise we reserve the right to: terminate, suspend, limit, prohibit access to, delete or remove you or your products and contents from our site. We will take legal action to keep users off our site (MyWeddingIsOver.com) if they create problems, legal liabilities or if they do not act accordingly to the terms we have in place.

Fees and Services

Becoming a registered member of MyWeddingIsOver and taking part in the bidding of an item is free. There are services we charge for like listing an item. During any transaction where there is a fee you will be able to review and accept the fees you will be charged. We also reserve the right to change the fee schedule. A 14-day notice will be placed in the site explaining the new fee schedule. For promotional events such as free listing days we reserve the right to change fees without prior notice.

All fees on MyWeddingIsOver are in U.S. dollars. You are responsible for paying all fees and taxes associated with MyWeddingIsOver sites and services with a valid payment method. If your payment is past due or fails to go through, we may collect fees through other methods such as collection agencies and legal counsel.

Content

When using the site, by uploading items you are giving MyWeddingIsOver non-exclusive worldwide, royalty free sublicensable right to use the copyrights and trademarks you have in your content in any form of media.

Liability

You will not hold MyWeddingIsOver responsible for other users content, actions, inactions, or items they list. You understand and acknowledge MyWeddingIsOver is not a traditional auctioneer. We created a site for users to bid buy and sell with each other. Therefore MyWeddingIsOver has nothing to do with the transactions between buyer and seller. MyWeddingIsOver does not guarantee safety, quality, legitimacy or legal aspects of any items advertised on the site. MyWeddingIsOver also does not guarantee that buyers will complete a transactions nor that sellers will complete a transaction. MyWeddingIsOver does not transfer any items from buyer to seller or from seller to buyer. We cannot guarantee continuous or secure access to our services, as many outside factors can interfere beyond our control. Furthermore we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, good will, or reputation, or any special, indirect, or consequential damages arising out of your use of our sites and services.

If we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100. Release

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Access and Interference

The sites contains robot exclusion headers. Much of the information on the sites is updated on a real-time basis and is proprietary or is licensed to MyWeddingIsOver by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the sites for any purpose without our express written permission. Additionally, you agree that you will not:

* take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;* copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for Your Information) from the sites without the prior expressed written permission of MyWeddingIsOver and the appropriate third party, as applicable; * interfere or attempt to interfere with the proper working of the sites or any activities conducted on the sites; or

* bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the sites.

We may amend this Agreement at any time by posting the amended terms on this site. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. Additionally, we will notify you through the MyWeddingIsOver Email Message Center. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.
